General terms and conditions of use

By entering your data, which is required for registration, and pressing the corresponding send button, a user relationship is established between the user and the Entrepreneurship Foundation, for which the following terms of use apply, which the user recognizes as binding:

Object of performance

The Entrepreneurship Campus is a network created by the Entrepreneurship Foundation.

Interested parties can register with a business idea and, after registration, access the content and information offered on the platform. 

On the website, the user can also subscribe to an e-mail newsletter containing up-to-date information on the competition. You can also unsubscribe from this newsletter at any time via the website.

Conclusion of contract and term

1. The contract of use between the Entrepreneurship Foundation and the user comes into effect upon successful registration by the user on the platform. By sending the confirmation e-mail, the Entrepreneurship Foundation accepts the user's offer to conclude a user contract.

2. The contract of use is concluded for an indefinite period.

3. Both the user and the Entrepreneurship Foundation are entitled to terminate the user relationship at any time without giving reasons and without observing a notice period. The notice of termination is given to the other party in electronic form (e-mail) or in text or written form.

User Obligations

1. The accounts are non-transferrable without the written consent of the Entrepreneurship Foundation. The same applies to the rights of the user arising from the contract of use; these are neither transferable nor assignable.

2. The user assures that all data and content provided by him during registration is true, up-to-date, available and complete. He is obliged to inform the Entrepreneurship Foundation immediately via email of any changes to his data.

3. The user must treat his password confidentially and secure this and his account against unauthorized access.

4. In the event of culpable loss of the password and/or if third parties gain knowledge of it, the user is responsible for actions taken under his account and shall indemnify the Entrepreneurship Foundation on first request from all resulting damages.

5. If the user loses his password or misuse of his access becomes known, he must immediately inform the Entrepreneurship Foundation via e-mail to the valid e-mail address given in the imprint.

6. If the Entrepreneurship Foundation becomes aware of possible misuse of the password, it is entitled to block the user's account and remove the user's content from the platform. In this case, the user will be informed immediately via e-mail about the reasons for the blocking.

7. The user undertakes to refrain from actions that violate system or network security or endanger the performance and availability of the platform.

Confidentiality Agreement

1. The user undertakes to maintain secrecy about all information entrusted to him as a template as part of the idea presentations, unless another user has expressly consented to disclosure.

2. The user undertakes to only evaluate the idea presented to him in cooperation with the trust-giver. An evaluation of the idea - in full or in part - will not take place without the consent of the idea originator.

3. The obligation of non-disclosure does not apply to ideas whose content consists of obvious know-how or can already be viewed from accessible sources.

Liability

Except as expressly stated in these Terms of Use or in the Additional Terms, Entrepreneurship Foundation makes no specific representations or warranties of any kind with respect to the Services. For example, Stiftung Entrepreneurship makes no promises regarding the content of the Services, specific functionalities of the Services, or the reliability, availability, or suitability of the Services for your purposes.

Data protection

The Entrepreneurship Foundation undertakes to comply with the applicable data protection laws. More details can be found in the data protection declaration, which can be called up in full at any time.

Disclaimer
The legal process is excluded. 

Final Provisions

Applicable law
German law applies exclusively to the user relationship, excluding the UN Sales Convention.

Place of jurisdiction
If the user does not have a general place of jurisdiction or if the user is a merchant, the place of jurisdiction for disputes about rights and obligations arising from this agreement is Berlin.

Severability clause
If one or more of the above provisions become ineffective, the operator and user undertake to replace them with a valid regulation that comes as close as possible to what was intended by the invalid regulation. The ineffectiveness of individual clauses does not affect the rest of the agreement. This does not apply if sticking to the user agreement would be unreasonable for the user.
